Our community has a homeowners’ association because it is a planned unit development with both individually owned “fee simple” properties and common areas owned by the association membership (homeowners) as a whole.
Services provided to homeowners include landscape maintenance, collection of garbage and recyclable materials and maintenance of he streets within the community. a monthly fee pays for these association services.
The Forsgate Community has three distinct neighborhoods. Beginning the late 1980s, they were developed on land that was formerly part of Forsgate Farms and later Forsgate Country Club.
The first neighborhood to be built was The Greens, consisting of 184 detached houses in several different models. It has a gated entrance on Fairway Boulevard, a swimming pool and a recreation center with fitness equipment, locker room and a social/meeting room.
Fairway’s Edge was the second phase built by the developer. It consists of 42 homes in pairs attached on one wall. Like The Greens, each includes at least two bedrooms (mostly three), at least 2½ bathrooms, a full basement and a two-car garage. Fairway’s Edge shares the gate, pool and recreation center with The Greens.
Pine Run was the final section constructed in the Forsgate Community, in the 1990s. It contains 92 homes, of which 60 are detached houses with at least three bedrooms. The other homes are attached in pairs along one wall. All Pine Run homes have at least 2½ bathrooms and a two-car garage. Some have basements.
Pine Run’s monthly fee is lower, because it does not have use of the gated entry, pool or recreation center.
Each owner or co-owner of a Forsgate Community home is a member of the Association. Each home is entitled to one vote in any election conducted by the association.
You have the right to use and benefit from the services and facilities of the community, but you have an obligation to follow the rules and policies established for all residents. You have the right to seek assistance from the Board and the management company for any question or problem you may encounter, but you have an obligation to do so in a courteous manner at an appropriate time and place.
You have the right to be interested and involved in all aspects of the association, but you have an obligation to do so in a responsible manner. In fact, your participation in the various committees is welcomed and encouraged. You have the right to a sound fiscal administration, but you have an obligation to pay your monthly fee or any special assessment promptly and fully.
You have both a right and an obligation to participate in association elections. Failure to vote on important issues deprives the community of a clear consensus of what is wanted and needed by the majority of owners, which may delay or impede decisions.
